Employers who have received approval to use a computerized format for IR56E submissions must submit the Employer's Notification along with the IR56E records in XML format to the Inland Revenue Department (IRD) via the Employer’s Return (ER) e-Filing Services. Submission can be done through either the Online Mode or Mixed Mode of the ER e-Filing Services.
Key points regarding the submission include:
The IR56E data file must be prepared in the prescribed XML format, compliant with the IRD’s data specifications.
Only employers with prior approval to use self-developed or computerized software for IR56E submission may file electronically in this way.
The maximum limit is 5,000 IR56E forms per data file per transaction via the ER e-Filing Services.
The submission must be signed by an authorized signer using digital credentials such as ITP password, MyGovHK password, iAM Smart+ digital signing, or a recognized digital certificate in Online Mode.
Mixed Mode allows a designated person to upload the file on behalf of the authorized signer.
Upon successful upload, a paper Control List with a transaction reference and QR code is generated for employer reference.
This procedure helps streamline the filing process, ensures data accuracy, and maintains compliance with the Inland Revenue Ordinance requirements for reporting new employees chargeable to Salaries Tax in Hong Kong.
When submitting IR56E records in computerized format, a printed copy of the forms does not need to be sent to the Inland Revenue Department (IRD). However, employers are still required to provide each employee with a copy of their IR56E form for reference.
